In Dubai, landlords typically require a refundable security deposit to cover potential property damages or unpaid bills. For unfurnished properties, this deposit is usually 5% of the annual rent, and for furnished properties, it's 10%. Tenants should carefully review their tenancy agreement to confirm the exact deposit amount. To avoid disputes, tenants should thoroughly inspect the property, document any existing damage with photos and videos, and share this documentation with the landlord. Maintaining records of maintenance requests, paying all bills, and adhering to the contract's notice period are also crucial.

If a landlord withholds the deposit without a valid reason, tenants can escalate the issue through Dubai's Rental Dispute Centre (RDC). The first step is to formally notify the landlord in writing, referencing the lease details and your rights. If amicable resolution fails, you can file a 'Writ of Payment' through the RDC's online portal. This legal petition requests the Dubai Land Department (DLD) to enforce the law and order the landlord to pay the owed amount.

To file a Writ of Payment, you'll need documents such as a recent Ejari (lease agreement) with a legal Arabic translation, proof of the debt amount, proof of the landlord's domicile, and proof of formal payment notification. Other required documents include a cheque return memo (if applicable), a signed declaration, Emirates ID copies, and supporting documents like correspondence and bills. The process involves registering on the RDC website, uploading documents, ensuring a five-day waiting period after the payment notice, and paying the service fees (3.5% of the claimed amount, with a minimum of Dh500 and a maximum of Dh15,000).

Once the case is registered, a judge reviews it, and the judgment is issued via the website and email. If the ruling favors the tenant, they will be instructed to visit the DLD to receive their deposit. Filing fees include the percentage of the claimed amount, plus additional fees for Power of Attorney registration, knowledge, innovation, and process service. If using a Real Estate Services Trustees Centre, an additional partner service fee applies.
